Terms of Use

You may use the Service only if:

• You are at least 18 years old.
• You have the legal capacity to enter into binding contracts under Tanzanian law.
• You provide accurate information about yourself.
• You have not been suspended or banned from the Service.

We do not allow third parties to use the Service on your behalf. Each account belongs to one individual or one legally registered business.

NyumbaNest exists to connect tenants directly with property owners — no brokers, no middlemen, no extra fees. This is our core promise to tenants and the foundation of how we operate. By listing on NyumbaNest, owners commit to the following:

• You will list only properties you own, manage as a legitimate agent, or have explicit written authority to list.
• You will deal directly with tenants who inquire — no broker handoffs, no referral commissions, no introductions through third parties.
• You will not charge tenants any fee for viewing, inquiring, or being introduced to your property beyond the rent, deposit, and customary lease costs.
• You will not list any property that is already represented by a broker who charges introduction fees.
• Your displayed contact information must reach you (or your legitimate co-owner/spouse), not a third-party broker.

Violation of the no-middleman covenant is the most serious breach on our platform. It may result in immediate listing removal, account suspension, account ban, and (in severe or repeat cases) being reported to authorities for consumer-protection violations.

If you use the Service as a tenant, you agree to:

• Send only genuine inquiries — do not spam owners with bulk messages.
• Treat owners and their property with respect during viewings.
• Inspect properties yourself before signing any lease or paying any money.
• Report scams, fake listings, or middleman behavior using the in-app flag tool.
• Not impersonate other people or use false contact details.

NyumbaNest is a marketplace that connects tenants and owners. We are not a party to any lease or rental agreement between users.

• We do not own, manage, or guarantee any listed property.
• We do not verify the truthfulness of every listing — we moderate to the best of our ability and rely on user reports.
• We do not hold deposits, escrow rent payments, or process rental payments.
• We do not vouch for the character of any owner or tenant.
• We do not represent any party in negotiations or disputes between an owner and a tenant.

You are responsible for your own due diligence: visit the property, verify the owner's identity, get a written lease, and only pay rent or deposits through methods you trust.

Anyone can flag a listing for review. When you flag a listing, you affirm that your report is truthful to the best of your knowledge. False or malicious reports may result in your account being suspended.

When we receive a flag, we review it against our policies. If we uphold the flag, we may:

• Issue a warning to the owner.
• Pause the listing pending owner correction.
• Reject the listing entirely.
• Suspend the owner's account if the violation is serious or repeated.
• Ban the owner permanently if the violation is severe (e.g. fraud, fake listings, predatory middleman behavior).

Owners can appeal any enforcement action via the appeal flow in the app. Appeals are reviewed by a different team member than the one who issued the action where possible.

NyumbaNest is currently free for both tenants and owners. We do not charge listing fees, contact fees, success fees, or commissions of any kind. If we introduce paid features in the future, they will be optional, clearly priced, and announced with at least 30 days' notice via SMS and on-site notification.

Tenants never pay NyumbaNest anything. If anyone claiming to represent us asks you for money, it is a scam — report it immediately.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of listings, the conduct of users, or the suitability of any property for your needs.

To the maximum extent permitted by Tanzanian law, SafariDigital Africa Company Limited and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Losses arising from your dealings with any other user, including landlords, tenants, agents, or third parties.
• Inaccurate, misleading, or fraudulent listings posted by other users.
• Property damage, theft, injury, or other harm occurring during property viewings or tenancies.
• Disputes over deposits, rent, or lease terms between you and another user.
• Interruptions, errors, or data loss in the Service.

Our total liability to you for any claim arising from the Service is limited to the amount you have paid us in the 12 months before the claim, or TZS 100,000, whichever is greater.

You agree to indemnify and hold harmless SafariDigital Africa Company Limited, its directors, employees, and contractors from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect via SMS or on-site notification. Continued use of the Service after the changes take effect means you accept the updated Terms.

These Terms are governed by the laws of the United Republic of Tanzania. Any dispute arising from these Terms or the Service will be resolved in the courts of Tanzania.

We encourage you to contact us first at nest@safaridigital.africa before escalating any dispute. Many issues can be resolved quickly through direct conversation.
